General Terms and Conditions
These General Terms and Conditions govern relations between Semper Opernball e.V. (organiser) and all guests of the Semper Opera Ball. The General Terms and Conditions apply to the Semper Opera Ball throughout the entire building of the State Opera House Dresden of Saxony on the day of the event.
Tickets (promenade or seat) can be ordered using the online form at www.semperopernball.de, via telephone on +49 351 484 54 66, fax on +49 351 484 55 66 or directly via email at firstname.lastname@example.org, exclusively with the booking form developed for this purpose. The booking form is available online or to download on the Semper Opernball e.V. website:
www.semperopernball.de The organiser always requires the full name, address, email and telephone number for private customers, and for corporate customers, the company name, name, title, email and a telephone number, in order to guarantee that the order can be processed correctly. If invoicing and delivery addresses are different, the organiser must be informed. Tickets can be ordered from 13 March 2017.
Tickets and price categories for seats can only be provided if available. Orders shall be considered received at the time that the booking form is received. If the requested ticket category is not available at the time the booking form is received, written notification will be sent out and the order will be put on a waiting list. The organiser reserves the right to contact people on the waiting list regarding their requests if tickets become available. If you wish to sit at a certain table or in a certain box, please feel free to let the organiser know. The organiser will take these requests into consideration but cannot make any guarantees. The organiser is usually responsible for placement.
Once you have placed your order you will receive written notification of receipt. This does not constitute a confirmation of your order. The invoice will be sent in the post or per mail and is valid without signature. Upon receipt of the invoice, a purchase contract based on the General Terms and Conditions is entered into with the organiser. The payment terms indicated on the ticket invoice are binding. The organiser reserves the right to terminate the purchase contract and put the tickets back up for sale if no payment is received after the payment deadline runs out on an overdue notice. Paid tickets are sent in the post eight weeks before the event at the earliest, or can be collected from our office at Schützenplatz 14, 01067 Dresden, Germany. There is no replacement for lost tickets.
Ticket payments must be made to the Semper Opernball e.V. account only: Ostsächsische Sparkasse Dresden, IBAN DE46 85050300 3200049064, BIC OSDDDE81XXX. Please always provide the invoice number as this allows us to assign the tickets. Ticket prices include the applicable VAT, which is listed separately.
In individual cases, the organiser reserves the right to accept returns of tickets already purchased and to charge a cancellation fee to cover damages and additional costs.
Changes to the casting or programme, cancellation of an advertised artist or changes to the programming schedule do not constitute a right to reimbursement for the cost of the ticket. Guests shall have no right to reimbursement of ticket or travel costs if the event is cancelled due to a force majeure. Guests shall have no right to reimbursement of the ticket cost if they miss the event for reasons of their own making or, for example, if trains/planes are cancelled or late, etc.
By reserving tickets, the customer agrees to having their data stored in the ticket system. Before tickets are made available for sale, Semper Opernball e.V. sends a one-off letter each year to customers in the database informing them of the current state of affairs and the date tickets will be made available for sale.
Entry to the Semper Opera Ball is only permitted with an entry ticket or authorisation.
Image, video and sound recordings during artists' performances are only permitted for private use and not for commercial use due to copyright reasons (and rights related to copyright). Not adhering to these rules will result in liability for damages.
Food and drink may not be brought onto the premises of the State Opera House Dresden.
Smoking is only permitted in spaces made available for smoking.
Cloakroom personnel will give guests using the cloakroom during the event a cloakroom ticket. Items will be returned to visitors presenting the ticket without any checks. Cloakroom personnel must be informed immediately if a cloakroom ticket is lost or damaged. The organiser accepts no responsibility on handing out cloakroom tickets, except in cases of gross negligence or intentional violation of the duty of care by cloakroom personnel. Liability is limited to the fair value of the item handed over to the cloakroom. No liability is accepted for cash or other items left in the clothing, such as mobile phones, jewellery, keys, etc. Such items are left in the cloakroom at the guest's own risk.
Guests may be denied access if they do not meet the dress code (available from the organiser). If there is reason to suspect that visitors are disrupting the event or harassing other guests, they may be denied access to the State Opera House Dresden. Visitors may be excluded from the event if they disrupt the event, harass other guests or take up seats for which they cannot provide valid tickets. Visitors may also be denied entry if they disregard instructions from personnel or violate these GTCs. This does not result in a right to reimbursement of the cost of the ticket or expenses.
The State Opera House Dresden, its representatives and contractors are only liable for any damages suffered by visitors to the State Opera House Dresden during the Semper Opera Ball if they are due to gross negligence or intent. These liability restrictions do not apply for claims resulting from loss of life or injury to limb or health.
The organiser collects, stores, amends and transfers personal data belonging to participants exclusively in accordance with federal data protection laws. Guests are hereby informed that the organiser uses the data for the transmission of information regarding current and future opera balls and associated events. Guests can withdraw consent for future use at any time. The withdrawal of consent does not require any reason, and the organiser can be informed in any form via the communication channels mentioned above.
Applicable law/place of performance/court of jurisdiction
German law applies to contracts and legal relationships based on these GTCs. Both the place of performance and court of jurisdiction for all contracts and legal relationships based on the GTCs is Dresden.
The Terms and Conditions are effective as of 01.04.2016.
